THE HON'BLE SMT. JUSTICE LALITHA KANNEGANTI CRIMINAL PETITION No.1453 of 2022 ORDER:

This petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioner/A-7 in the event of her arrest in connection with Crime No.215 of 2021 of WCO Team-IX, Central Crime Station, Hyderabad, registered for the offences punishable under Sections 406, 417, 420, 465, 468, 471, 477-A read with 34 IPC and under Section 66-D of Information Technology Act, 2000-2008. 2.

The case of prosecution is that the Registrar of Companies, Hyderabad, has lodged a complaint stating that 12 companies of Hyderabad were submitted false and fabricated documents and incorporated/registered their companies under Companies Act and all those companies are fictitious.

Learned counsel for the petitioner/A7 Mr. P. Shashi Kiran, submits that the petitioner's husband is arrayed as A3 and the allegation against A3 is that he has agreed to open three fake companies on paper and opened three companies, wherein the petitioner/A7 and some others were

Learned counsel further submits that the petitioner has nothing to do with the alleged offences and in fact, all the allegations are against A3, who was already released on regular bail, and hence, her case may be considered for grant of pre-arrest bail. 4.

On the other hand, learned Assistant Public Prosecutor submits that release of A3 on regular bail cannot be a ground for grant of prearrest bail to the petitioner. He submits that the investigation is pending and so far, 8 witnesses were examined. He further submits that there are specific overt acts against the petitioner, as such, she is not entitled for pre-arrest bail.

Taking into consideration the fact that all the allegations are against A3, who was already granted regular bail, this Court deems it appropriate to grant pre-arrest bail to the petitioner-A-7. 6.

The Criminal Petition is allowed. Petitioner - Accused No.7 shall surrender before the Station House Officer, WCO Team-IX, Central Crime Station, Hyderabad, in connection with Cr.No.215 of 2021 within one week from today and on such surrender and executing a personal bond

LK, J Crl.P.No.1453 of 2022 for Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the said Station House Officer, she shall be released on bail.
