THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.34377 of 2016 ORDER:

The petitioners pray for Mandamus declaring the action of respondents 2 and 3 in proceeding to demolish their houses bearing Door Nos.4-1-10-15 and 4-1-10-16 at Hill Road, Christian Peta, Atmakur Town, SPSR Nellore District, without recourse to law as illegal and unconstitutional.

The petitioners in support of their actual and physical enjoyment of the subject matter of the writ petition have placed photographs showing old houses covered by these Door Numbers and also house tax received by the local authority. Their grievance is that even for road widening, respondents 2 and 3 are under obligation to issue notice to petitioners, follow procedure stipulated by law and take recourse to demolition or dispossession thereafter. Sri S.D.Saleem, learned Standing Counsel for respondent No.2 makes a statement that there is a proposal to widen the existing Hill Road at Atmakur Municipality and respondents 2 and 3 will follow the procedure stipulated by law either for demolition or dispossession of petitioners for widening the Hill Road.

The Writ Petition is disposed of by accepting the statement made in this behalf.
