THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.34948 OF 2016 ORDER:

The writ petition is filed by the petitioners seeking a writ of mandamus declaring the action of the respondents 2 to 4 at the instance of the fifth respondent in interfering with the possession of the petitioners property in survey Nos.160, 162, 163/1, 164 and 165/1 admeasuring Acs.8.14 guntas situated to Lal Bahadur Nagar Colony, Mailaredevpally Gram Panchayat, Rajendranagar, Ranga Reddy District, as illegal arbitrary.

Heard and perused the material.

Learned counsel for the petitioners submits that the respondents 2 to 4 are interfering with the peaceful possession of the petitioners over their property, at the instance of the fifth respondent, without therebeing any complaint registered against the petitioners. He further submits that the fifth respondent is trying to grab the land of the petitioners and it is a civil dispute and that the respondents 2 to 4 are interfering with the civil disputes between the petitioners and the fifth respondent. Hence, he seeks a direction to the respondents 2 to 4 not to interfere with the civil disputes between the petitioner and the fifth respondent. Learned Assistant Government Pleader for Home (Telangana) submits that the respondents 2 to 4 are not interfering with the affairs of the petitioners, and more particularly the civil disputes between the petitioners and the fifth respondent.

Considering the rival submissions made by both the counsel, the writ petition is disposed of with a direction to the respondents 2 to 4 not to interfere in the civil disputes between the petitioners and the fifth respondent. The respondents 2 to 4 are further directed to follow the due process of law laid down in Code of Criminal Procedure.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 01.11.2016 pln
