No. 1 OF 2016 J U D G M E N T : (per Hon'ble Sri Justice Nooty Ramamohana Rao) This Letters Patent Appeal is preferred under Clause 15 of the Letters Patent aggrieved by the directions issued by a learned Single Judge of this Court in C.C. No. 382 of 2011 on 08.07.2011. It is now brought to our notice that when L.P.A. No. 2 of 2012 was preferred thereagainst, a Division Bench of this Court, following the judgments rendered by the Supreme Court in Midnapore People's Coop. Bank Ltd. v. Chunilal Nanda {(2006) 5 SCC 399} and B.R. Meena, ViceChairman and Commissioner, A.P. Housing Board and others v. T. Bajrang and others {2011 (4) ALT 709 (D.B.)

}, held that the LPA is maintainable and then, on merits has set aside the order passed by the learned Single Judge in C.C. No. 382 of 2011 dated 08.07.2011. In view of the judgment rendered by another Division Bench in L.P.A.No. 2 of 2012 on 09.09.2015, the cause in this LPA does not survive, as the order passed by the learned Single Judge in C.C. No. 382 of 2011 itself is set aside. Hence, no further orders are needed to be passed in this Letters Patent Appeal and it is accordingly, dismissed. No costs.
