THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36841 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondents 3 to 5 in harassing the petitioner in connection with an unregistered crime lodged by the sixth respondent and forcing the petitioner to marry the sixth respondent as being arbitrary and illegal.

Heard and perused the material.

Learned counsel for the petitioner submits that according to the sixth respondent, there was a love affair between the petitioner and the sixth respondent and that the fifth respondent called the petitioner to the police station on 25.10.2016 and forced him to give a letter stating that he married the sixth respondent and they are living together as husband and wife and that he would inform his parents regarding the marriage in two days. He further submits that the respondents 4 and 5 threatened the petitioner to book a case under Nirbhaya Act if he does not give letter to the said effect. He further submits that there is no relationship between the petitioner and the sixth respondent.

He further submits that in the guise of the said letter, which was obtained by the respondents 4 and 5 forcibly from the petitioner, the respondents 4 and 5 are harassing the petitioner to marry the sixth respondent and also forcing him to lead a marital life with the sixth respondent. Considering the facts and circumstances of the case, the respondents 4 and 5 are directed not to harass the petitioner without therebeing any crime registered against the petitioner. The respondents 4 and 5 are directed to proceed in accordance with law.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 31.10.2016 pln
