HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.281 of 2016 ORDER:

This petition is filed to withdraw F.C.O.P.No.426 of 2016 from the file of Family Court (IV Additional District Judge), Ranga Reddy District at L.B.Nagar, and transfer the same to Family Court, Khammam.

2. Wife filed this petition. According to her affidavit, her marriage with respondent was performed on 29.08.2013 at IMA Function Hall, Pavilion Ground, Khammam, as per Hindu rites and custom. She stated that during their wedlock they were blessed with a female child. She further stated that after marriage respondent used to abuse her in filthy language and harassed her both physically and mentally and in the panchayats elders admonished him and his mother. She further stated that as respondent and his mother did not change their attitude and did not stop harassing her, she was necked out from the house on 28.01.2016 and that she went to her parents' house and since then she has been staying with her parents. She stated that she lodged a complaint with Women Police Station, Khammam, which is registered as Crime No.

10 of 2016 and respondenthusband intentionally filed divorce petition before Family Court, Ranga Reddy.

adjournment as there are no male persons to accompany her.

She stated that she is suffering from financial problem and she cannot meet the travel expenses from Khammam to Ranga Reddy, which is 200 kms., for these reasons, she prayed for transfer of F.C.O.P.No.426 of 2016 from Family Court, Ranga Reddy to Family Court, Khammam.

This Court permitted petitioner to take personal notice to respondent through registered post with acknowledgment due and in compliance of the said order, notice was sent to respondent on 29.04.2016 and as per the postal acknowledgment, the same was served on respondent on 16.05.2016. In spite of service of notice respondent neither appeared in person nor through any advocate.

4. Heard advocate for petitioner.

5. Considering the reasons stated in the affidavit filed in support of petition and also considering the convenience of the wife, F.C.O.P.No.426 of 2016 is withdrawn from Family Court (IV Additional District Judge), Ranga Reddy District at L.B.Nagar, and transferred to Family Court, Khammam, for disposal in accordance with law.

6. Accordingly, this transfer C.M.P. is ordered.

7. Miscellaneous petitions pending, if any, shall stand closed.
