HON'BLE SMT JUSTICE ANIS CRIMINAL M.P. NOs.15962 & 15963 OF 2016 IN/AND CRIMINAL PETITION No.14137 OF 2016 COMMON ORDER:

This Criminal Petition is filed by the petitioners/A.1 & A.2 under Section 482 of the Code of Criminal Procedure, 1973 to quash the proceedings against them in Crime No.248 of 2015 on the file of Bhadrachalam Town Police Station, Khammam District, which was registered under Sections 420, 468, 471 and 506 of the Indian Penal Code, 1860 (for short 'IPC').

2. The first petitioner/A.1 and the 2nd respondent/de facto complainant are present. Sri. P. Vishnuvardhana Reddy, learned counsel appearing for the petitioners represented that second petitioner/A.2 is suffering with fever and is not in a position to attend the Court, but in fact the matter was compromised between the parties. They produced Aadhar Cards issued by the Government of India, which show their identity. They were also identified by their counsel. They filed a compromise petition, wherein they stated that they have amicably settled the matter. The 2nd respondent/ de facto complainant voluntarily stated that he has no objection to quash the proceedings against the petitioners. 3.

The offences alleged are punishable under Sections 420, 468, 471 and 506 IPC, out of which Section 420 shall be compounded with the permission of the Court.

In view of compromise, the chance of conviction is bleak and remote. Therefore, in view of the fact that the matter has been amicably settled and the offences punishable are compoundable, there is no impediment to quash the proceedings against the petitioners. 5.

Accordingly, Crl.M.P.NOs.15962 of 2016 and 15963 of 2016 are ordered. Consequently, the Criminal Petition is allowed, quashing the proceedings against the petitioners/A.1 & A.2 in Crime No.248 of 2015 on the file of Bhadrachalam Town Police Station, Khammam District. Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
