HON'BLE SMT. JUSTICE LALITHA KANNEGANTI CRIMINAL PETITION No. 1454 of 2022 O R D E R:

This Criminal Petition under Sections 437 and 439 Cr.P.C. is filed by petitioner - Accused No.3 in Crime No. 215 of 2021 on the file of Humayun Nagar Police Station registered for the offences punishable under Sections 307, 341 and 506 read with Section 34 I.P.C., seeking bail.

The case of prosecution is that Accused No.1 along with other accused, bore previous grudges. On 16.12.2021, at about 11.50 p.m., opposite to Mahaveer Hospital in front of JNFAC, Masab Tank, Hyderabad, stabbed the victim Syed Numan with knife mercilessly on stomach, ribs, back and hand with an intention to kill him. It is alleged that the victim sustained severe injuries and was admitted to hospital with the help of local people.

Learned counsel for the petitioner, Sri K. Venumadhav, submits that in view of the earlier disputes between Accused No.1 and de facto complainant's daughter, the present case is foisted and petitioner is arrayed as accused No.3. It is submitted that the petitioner was

LK, J Crl.P.No.1454 of 2022 arrested and remanded to judicial custody on 24.12.2021 and from the last 59 days, he has been languishing in jail. He further submits that the injuries sustained by the victim are simple in nature and he was treated and discharged immediately. No useful purpose would be served by making the petitioner to languish in jail further. Hence, the learned counsel requests that the case of the petitioner may be considered for grant of bail.

Learned Assistant Public Prosecutor submits that so far, six witnesses were examined and Accused Nos. 1, 6, 7, and 4 were arrested and enlarged on bail.

Taking into consideration the nature of disputes between the parties and further as the petitioner is languishing in jail from 24.12.2021, and as other accused were already enlarged on bail, this Court deems it appropriate to grant bail to the petitioner also. 6.

The Criminal Petition is, therefore, allowed. Petitioner - Accused No.3 shall be enlarged on bail in connection with Crime No. 215 of 2021 on the file of Humayun Nagar Police Station on his executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only)
