PNR,J W.P.No.11249 of 2016 HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Disciplinary proceedings and criminal proceedings were initiated against the petitioner on various allegations/charges. Disciplinary proceedings resulted in imposing punishment of dismissal from service by order dated 25.08.2004. Appeal filed against the said order was also rejected. Two criminal cases were instituted against the petitioner i.e., CC.Nos.229 of 2005 and 258 of 2005 on the file of Judicial Magistrate of First Class, Mulugu. The Judicial Magistrate of First Class, Mulugu, by judgments dated 10.12.2013 and 31.12.2013, respectively, acquitted the petitioner for the charges leveled against him. After his acquittal, petitioner filed appeal on 05.02.2014 to review the decision of dismissal from service and to grant consequential benefits.

Learned counsel for petitioner as well as learned standing counsel for respondents submit that appeal filed on 05.02.2014 is not disposed.

Since appeal is pending, the writ petition is disposed of, directing the Deputy General Manager (2nd respondent) to consider the representation/appeal dated 05.02.2014 and to pass appropriate orders as warranted by law as expeditiously as possible, preferably within a period of six weeks from the date of receipt of copy of this order.
