HON'BLE SRI JUSTICE S. RAVI KUMAR CIVIL REVISION PETITION No.388 of 2005 ORDER :
This revision is preferred questioning order dated 12.10.2004 in I.A.No.2261 of 2004 in O.P.No.55 of 2001 on the file of I-Additional Chief Judge, City Civil Court, Secunderabad.
2. Revision petitioners herein are claimants in O.P.No.55 of 2001 and Motor Accident Claims Tribunal (for short, 'Tribunal) awarded a sum of Rs.2,04,000/- as compensation with interest at 9% p.a. and out of which, claimant No.1 was allotted Rs.48,800/-, claimant Nos.2 to 4 were allotted Rs.33,800/- each, claimant No.5 was allotted Rs.20,000/- and claimant No.6 was allotted Rs.33,800/-. As per award, Tribunal directed to deposit the share of minors i.e., claimant Nos.2 to 4 in a nationalized Bank and permitted claimant No.1/guardian to withdraw the accrued interest for the maintenance and educational expenses of the minor claimants. The Tribunal deposited minors' amount before State Bank of Hyderabad, A.D.B. Gajwel Branch and claimant No.1 filed I.A. seeking directing to credit interest amount to her account and that application was dismissed.
Aggrieved by the same, present revision is preferred.
3. Now from the submissions of advocate for revision petitioners, claimant Nos.2 to 4 have now attained
majority, therefore, nothing survives in the revision and the same can be disposed of by observing that claimant Nos.2 to 4 can approach the Tribunal for appropriate orders.
4. Accordingly, revision is disposed of giving liberty to claimants No.2 to 4 to approach the Tribunal for appropriate orders.
5. Miscellaneous petitions pending, if any, shall stand closed. No costs.
