THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.21195 of 2016 ORDER:

The petitioner was appointed as Incharge of the MLS point in the year 1984 in the first respondent Corporation. A news item appeared in the local newspaper on 13.03.2003 on the basis of which the petitioner was placed under suspension on 04.04.2003. He submitted his explanation on 07.04.2003 denying the charges. He was reinstated to duty after submission of report by the Revenue Divisional Officer, Vikarabad. Thereafter he was transferred to Sangareddy, Medak District. However, an Enquiry Officer was appointed after two years and a charge memo was issued on 27.04.2005. The petitioner submitted his explanation on 27.05.2006. Ultimately he retired on 30.06.2013. When retirement benefits were not released, he filed the present Writ Petition.

When the Writ Petition is take up for consideration, learned Standing Counsel for the respondents produced before this Court a copy of the order No.P.Admn.A4/5237/2003, dated 04.08.2016, dropping the charges against the petitioner consequent to the report submitted by the Enquiry Officer. The period of suspension was also treated as on duty. In view of the same, it is for the first respondent to pay the retiral benefits due to the petitioner as expeditiously as possible. The Writ Petition is, accordingly, disposed of directing the first respondent to calculate the retiral benefits due to the petitioner and pay the same, within a period of three months from the date of receipt of a copy of this order. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.
