THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39029 of 2016

ORDER

This writ petition is filed by the petitioners seeking to declare the inaction of 2nd respondent in granting protection to their household properties by taking legal action against the unofficial respondents, who are violating the Court decree, as illegal and arbitrary.

It is stated in the affidavit that though the petitioners are decree holders in O.S.Nos.343 and 344 of 2006 on the file of Principal Junior Civil Judge, Mancherial, Adilabad District, with regard to subject property, respondents 3 and 4 by creating fake and fabricated documents in the name of respondents 5 to 8 trespassed into the said property and threatened them with dire consequences and also tried to kill them by abusing in filthy language. Therefore, the petitioners filed written complaints on 10.06.2014 and on 09.11.2016 before the 2nd respondent-Station House Officer, CCC Naspur Police Station, Mancherial District, for police protection, but no action has been taken thereon. Hence, the writ petition. 3.

Heard both sides and perused the material on record. 4.

Considering the facts and circumstances of the case and in view of the civil disputes between the parties, without going into the merits of the matter, I deem it appropriate to direct the 2nd respondent to take appropriate decision on the complaint dated 09.11.2016 filed by petitioners if there is a threat of their lives and pass appropriate orders in accordance with law.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
