THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE SRI JUSTICE N.BALAYOGI CONTEMPT CASE NO.851 OF 2017

O R D E R

(Per Hon'ble Sri Justice Sanjay Kumar) This contempt case was instituted alleging willful disobedience to the order dated 10.02.2017 passed by this Court in W.P.No.38081 of 2015. By the said order, this Court directed the authorities to pass appropriate orders under F.R.54-B of the Andhra Pradesh Fundamental Rules in relation to the petitioner's suspension period within a time frame.

Learned Assistant Government Pleader for Services produced Memo No.570/Vig.II/2002-17 dated 05.06.2017 issued by the Principal Secretary to Government, Panchayat Raj and Rural Development, in purported compliance with the aforestaed order. In that view of the matter, this Court finds no disobedience, much less willful disobedience, to its order warranting exercise of contempt jurisdiction. In the event the petitioner is aggrieved by the decision embodied in the Memo dated 05.06.2017, he would necessarily have to seek redressal of such grievance by way of independent proceedings. Reserving liberty to the petitioner to do so, the contempt case is closed. No order as to costs. ______________________ SANJAY KUMAR, J ____________________ N.BALAYOGI, J 16th JUNE, 2017 Svv
