THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY C.R.P.No.1035 of 2018 ORDER:

This revision petition is filed under Article 227 of the Constitution of India assailing the order dated 08.01.2018 passed in I.A.No.308 of 2017 in O.S.No.113 of 2015 on the file of I Additional Junior Civil Judge Court, Bhimavaram, dismissing the petition filed by the petitioner under Order 9 Rule 7 CPC, seeking to set aside the exparte order dated 28.06.2017. 2.

Heard the learned counsel appearing for both the parties and perused the material on record.

Today, this Court passed elaborate order allowing the C.R.P.No.965 of 2018 which was filed assailing the order passed in I.A.No.306 of 2017 in O.S.No.113 of 2015 to reopen the suit for adducing defendant's side evidence.

In view of the order passed by this Court in C.R.P.No.965 of 2018, there is no need to pass separate elaborate order in this revision petition.

Accordingly, the Civil Revision Petition is allowed setting aside the order dated 08.01.2018 passed in I.A.No.308 of 2017 in O.S.No.113 of 2015 on the file of I Additional Junior Civil Judge Court, Bhimavaram. Consequently, I.A.No.308 of 2017 in O.S.No.13 of 2015 is allowed. No order as to costs.
