THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.9150 OF 2016 O R D E R :

Heard counsel for the petitioner, Government Pleader for Revenue appearing for respondent Nos.1 to 3 and Government Pleader for Forests appearing for respondent No.4.

2. Petitioner in this writ petition sought direction to respondent No.2, to decide the revision petition pending before him, pursuant to a remand made by the then Commissioner, Land Revenue, Government of Andhra Pradesh through letter No.BB4/3916 /86 dt.11.12.1989. In this proceeding, the petitioner is complaining of conversion of land claimed by him as Kharij Katha.

3. The Government Pleader for Revenue has referred to the letter dt.16.01.2016 issued to the petitioner's son that the file referring to proceedings of the case is destroyed and is unavailable.

4. The Government Pleader for Revenue also contends that the petitioner had kept quiet about the revision for more than twenty (20) years and at this point of time, it is difficult to reconstruct the record and decide the matter. He suggested that the petitioner to make a fresh application before respondent No.2 regarding his grievance and stated that respondent No.2 will look into

the matter in accordance with law and communicate his decision thereon to the petitioner.

4. In view of the said submission, the Writ Petition is disposed of directing the petitioner to submit a fresh application to respondent No.2 with regard to his grievance about conversion of land claimed by him into Kharij Katha and within a period of twelve (12) weeks from the receipt of the said application, respondent No.2 will communicate his decision thereon to the petitioner. There shall be no order as to costs.

5. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
