HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36344 of 2016 ORDER:

This writ petition is filed by the petitioners under Article 226 of the Constitution of India seeking to direct the respondents herein particularly respondents Nos.3 and 4 not to interfere with the civil disputes and not to call the petitioner to the 4th respondent-police station in connection with a House bearing No.3-217/3, situated at Naya Nagar, Kodad Town and Municipality.

Heard and perused the material available on record. 3.
It is stated in the affidavit that the petitioner and his friend purchased the subject house from Challa Kotamma by virtue of a registered document. While so, the unofficial respondents Nos.5 to 8 with an intention to deceive the petitioner, transferred the subject house illegally under the guise of a gift deed in favour of the 5th respondent's wife. The petitioner lodged a complaint against respondents Nos.5 to 8 and the same is pending. It is the grievance of the petitioners that respondents Nos.3 and 4 are interfering with the civil disputes between the petitioner and the unofficial respondents in respect of the subject house. 4.
Considering the circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, the Writ Petition is disposed of with the following direction:
"Respondents Nos.3 & 4 are directed not to interfere with any of the civil disputes between the petitioner and the unofficial respondents in respect of the subject house. At the same time, this order will not stand in the way of the above said official
respondents to proceed with the investigation, if any cases are registered against the petitioner for cognizable offence. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
