THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.27639 of 2017 ORDER:

Shorn of details, issue for consideration at this stage is that an application filed by petitioner on 03.09.2015 for mutation of entries and issuance of pattadar pass book in respect of her share of property to an extent of Acs.5.08 cents in Survey No.295 and Acs.2.13 cents in Survey No.294 of Padarthi Village, Kothapatnam Mandal, Prakasam District, was rejected by respondent No.3 - Tahsildar, Kothapatnam Mandal. Aggrieved thereby, petitioner/claimant filed appeal bearing No.3747 of 2016 before respondent No.2 - Revenue Divisional Officer, Ongole. Alleging inaction of respondent No.2 in disposing of such appeal, this writ petition is filed.

Since appeal is filed aggrieved by the decision of Tahsildar and the same is pending consideration before respondent No.2, this Court is not inclined to enter into merits of the matter. Accordingly, Writ Petition is disposed of directing respondent No.2 to consider the appeal said to have been filed by petitioner and pass orders as warranted by law, as expeditiously as possible, preferably, within a period of two months from the date of receipt of a copy of this order. If necessary, he may put on notice the aggrieved party, if there is any rival claim on the issue.

Pending miscellaneous applications, if any, shall stand disposed of in consequence.
