THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.21798 OF 2015 ORDER:

The petitioner is a widow and after expiry of her husband, in order to eke out her living, she installed a telephone booth in the slum area which is far inside from the main road and the name is known as NBT Nagar. The authorities of the respondent Corporation have been threatening to remove the telephone booth alleging that it is not authorised and that such a booth cannot be installed. According to the learned counsel for the petitioner, the booth is installed in a private land and aggrieved by the threats made on her, several representations are made, but no action is taken. Hence, the petitioner is constrained to file the Writ Petition.

When the Writ Petition is taken up for consideration, learned Standing Counsel for the respondent Corporation fairly submits that the respondent Corporation shall follow the due process of law before taking any coercive action against the petitioner. Having regard to the statement made by the learned Standing Counsel, the Writ Petition is disposed of as no further orders are required. There shall be no order as to costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
