Damodaram Petitioner (Accused No.3 in Cr.No.771/2014 of Patamata P.S., Vijayawada, Krishna Dist) AND State of Andhra Pradesh, rep by its Public Prosecutor, High Court of Judicature at Hyderabad, through Station House Officer, Patamata Police Station, Vijayawada City. Respondent/Complainant Petition under Sections 437 & 439 of Cr.P.C. praying that in the circumstances stated in the grounds filed herein, the High Court may be pleased to pass an order by enlarging the petitioner herein on bail in NDPS SC.No. 97/2015 in Crime No. 771/2014 of Patamata P.S., Vijayawada City, Krishna District in the interest of justice. The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri Chandra Sekhar Ilapakurti, Advocate for the Petitioner and of the Public Prosecutor (AP) for the Respondent, the Court made the following ORDER:
" This petition is filed, under Sections 437 and 439 of the Criminal Procedure Code, 1973, seeking to enlarge the petitioner, who is A3, on bail in Crime No.771 of 2014, on the file of Patamata Police Station, Vijayawada, Krishna District, for the offences punishable under Sections 8(b) r/w 20(c) of NDPS Act, 1985.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The counsel for the petitioner submits that earlier this petitioner was granted bail, but, due to his absence before the trial court, NBW was issued. 4.
Hence, considering the fact that earlier the petitioner was earlier on bail, this Court is inclined to grant bail to the petitioner. 5.
Accordingly, this Criminal Petition is allowed and the petitioner is directed to be enlarged on bail on condition of his executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) each with two sureties each for a like sum each to the satisfaction of the Metropolitan Sessions Judge Court - cumSpecial Judge for Trial of NDPS Act Cases, Vijayawada. As a sequel, the miscellaneous applications, if any pending, shall stand closed."
