HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 14918 of 2009 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents. The present writ petition came to be filed seeking issuance of writ of mandamus declaring the notice issued by the 2nd respondent vide Rc.No.231/09(B) dated 14.07.2009 calling upon the petitioner to submit an explanation as to why the borewell should not be seized and closed within seven days, as illegal and arbitrary. By an order dated 04.08.2009, this Court, while issuing rule nisi, granted interim suspension of the impugned notice. The learned Government Pleader for revenue submits that without giving an explanation to the notice dated 14.07.2009 issued by the 2nd respondent, the petitioner approached this Court by way of the present writ petition. At this stage, the learned counsel for the petitioner submits that he will submit an explanation to the notice, and till such time, the interim order granted by this Court earlier may be continued.

Having regard to the circumstances stated above and without going into the merits of the case, the Writ Petition is disposed of, directing the petitioner to submit an explanation to the notice dated 14.07.2009 issued by the 2nd respondent within a period of four (4) weeks from today, in which event, the 2nd respondent shall pass orders thereon, in accordance with law, within a period of twelve (12) weeks thereafter. Till such time, the interim order granted by this Court on 04.08.2009 shall continue. There shall be no order as to costs.

Consequently, miscellaneous petitions if any pending in the writ petition shall stand closed.
