THE HON'BLE SRI JUSTICE N.BALAYOGI Criminal Petition No.7451 of 2011 ORDER:

As can be seen from the proceeding sheet, as there is no representation for the petitioners on 22.09.2017, in the interest of justice the matter was adjourned to 23.10.2017 finally. On 25.10.2017, despite posting the matter finally the counsel for petitioners requested time and accordingly, ordered to post the matter in the first week of November, 2017 under the caption " for dismissal" . Despite the same there is no representation for the petitioners on the next date of hearing on 28.12.2017 and hence, the matter was adjourned to 29.12.2017. On 29.01.2018, it was represented that the learned counsel for petitioners is not well and requested for adjournment and accordingly, the matter was adjourned to 05.02.2018. Even today also the learned counsel representing the counsel for the petitioners seeks adjournment on the ground that the learned counsel for petitioners is not well. 2.

In view of the above, it appears that on all the occasions the petitioners are not showing any interest in pursuing the matter and the counsel appearing for them seeking adjournment on one ground or the other. It is thus emerges that the petitioners are not diligent and have no interest to prosecute the matter.

NBY, J Crl.P.No.7451 of 2011 Accordingly, this Criminal Petition is dismissed for nonprosecution. Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
