HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Criminal Revision Case No.398 of 2018 ORDER:

Heard learned counsel for petitioner and this Crl.R.C. is disposed of at the admission stage, as this Court finds no reason to order notice to respondents.

2) This Criminal Revision Case is preferred by the petitioner aggrieved by the docket order dated 10.01.2018 in C.C.No.433 of 2017 on the file of II Special Magistrate, Hyderabad whereby and whereunder the learned Judge dismissed the petition filed under Section 317 Cr.P.C. to dispense with the presence of the petitioner and issued NBW. 3) Having regard to the facts and circumstances of the case, this Crl.R.C. is allowed and the petitioner/accused is directed to appear before the trial Court on 28.02.2018 and file an application for re-call of NBW in which case the trial Court shall re-call NBW. The petitioner/accused is further directed to cooperate with the trial Court for smooth completion of trial.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
