HON'BLE SRI JUSTICE S.V.BHATT W.P.Nos.44047, 44062, 44072, 44107, 44138, 44225 AND 44245 OF 2016 COMMON ORDER:

Heard Mr.N.Harinath for petitioners and the Assistant Government Pleader for Revenue. No representation for 3rd respondent Municipality.

The petitioners pray for direction more particularly one in the nature of writ of Mandamus declaring the inaction of respondents 2 & 3 in devising the compensation package for the affected land and buildings of the petitioners situated on the existing 30' road leading to the Rural Police Station from the Koppaka Venkaiah Vegetable Market at Ponnur, Guntur District, as illegal and against the principles of natural justice.

The petitioners assail notice dated 03.10.2016 issued under Section 146 of H.M.C. Act 1955. This Court is of the view that the petitioners can avail the opportunity afforded through notice dated 03.10.2016 and file objections/ explanation before 3rd respondent. The 3rd respondent would have the opportunity of considering the objections/ explanation and a decision is taken in this behalf. The petitioners if are aggrieved by such decision can certainly work out their grievance in accordance with law. Keeping in view the above circumstances, the writ petitions are disposed of by this Order.

a) The petitioners are given two weeks time from today to file objections/ explanation to the notice served on the petitioners.

b) The 3rd respondent is directed to consider the objections/ explanation and communicate the decision taken in this behalf within further period of three weeks thereafter.

The writ petitions are disposed of accordingly. No order as to costs.
