THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.36009 OF 2016 ORDER :

Petitioner alleges that even though Government passed orders on 07.06.2016 suspending the order of cancellation of Toddy licence of toddy tappers, the same is not implemented and petitioner is not allowed to undertake sale of toddy operations. 2.

It is not in dispute that the order passed by the Government is in favour of the petitioner and this order according to the petitioner is required to be complied by the subordinate authority of the Government. If the order of the Government is not complied by the subordinate authority, it is for the petitioner to complain to the Government informing that its subordinates have not complied the order and should seek enforcement of such orders from the Government. In exercise of power of judicial review under Article 226 of the Constitution of India, this Court cannot act as implementing agency for the decision of the Government. Therefore, the writ in the present form is not maintainable and is liable to be dismissed.

Accordingly, the Writ Petition is dismissed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
