THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5942 OF 2016 ORDER:
This Criminal Petition is filed under Section 482 of Code of Criminal Procedure, 1973 by the petitioners/A-1 and A-4 seeking to quash the docket order, dated 7.4.2016, in C.C.No.263 of 2010 on the file of the Additional Judicial Magistrate of First Class, Avanigadda, Krishna District.
2. Heard and perused the material available on record.
3. The offences alleged against the petitioners are punishable under Sections 147, 148, 324 and 506 read with 149 I.P.C.
4. Learned counsel for the petitioners submitted before this Court that N.B.Ws are pending against the petitioners and the same may be recalled; that the petitioners are ready to face the trial and they will not flee from the hands of justice.
5. Having heard the learned counsel for the petitioners and the learned Public Prosecutor and having perused the material available on record, this Court is of the view that this Criminal Petition can be disposed of with the following directions:
The petitioners/A-1 and A-4 are directed to approach the Court concerned and file a petition to recall the warrants issued against them and on such petition being filed, the Court concerned is directed to recall the warrants on the same day on their execution of a bond for a sum of Rs.5,000/- (Rupees five thousand only) each with one surety for a like sum each and further, the petitioners are directed to appear before the trial Court regularly.
6. Accordingly, the Criminal Petition is disposed of. Miscellaneous
