THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.674 of 2016 ORDER:

The grievance of the petitioner is with regard to the maintenance of a rowdy sheet in his name on the file of Khanapuram Haveli Police Station, Khammam District.

The Sub-Inspector of Police, Bonakal Police Station, filed a counter-affidavit stating that the rowdy sheet was opened in the name of the petitioner in December, 2013, at which point of time he was involved in three crimes. However, it is an admitted fact that out of the three crimes, one ended in acquittal of the petitioner vide judgment dated 05.12.2014 in C.C.No.423 of 2012. However, the other two cases are still pending trial. The Sub-Inspector of Police further stated that the rowdy sheet had been transferred from Khanapuram Haveli Police Station to Bonakal Police Station in May, 2015, and presently stands extended till 31.12.2016. Sri Karunakar Reddy, learned counsel for the petitioner, would state that a similarly situated person viz. Mikkilineni Narendar, S/o. Chandram was given the benefit of closure of the rowdy sheet opened in his name and claimed similar relief.

However, as it is for the police authorities to apply their mind to the issue and take a reasoned decision thereon, the writ petition is disposed of permitting the petitioner to make an appropriate application to the police authority concerned seeking closure of the rowdy sheet in his name being maintained presently on the file of Bonakal Police Station. In the event such an application is made, the authority concerned shall consider the same in the light of the law laid down by this Court in K.SURESH BABU V/s.

THE SUPERINTENDENT OF POLICE, ANANTAPUR DISTRICT[1] and the relevant Standing Orders. In the event the authority decides to reject the request of the petitioner for closure of the rowdy sheet, the reasons therefor shall be recorded and duly communicated to him.

This exercise shall be completed expeditiously and in any event, not later than six weeks from the date of receipt of the petitioner's representation.
