THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 2428 OF 2017 O R D E R :

This Writ Petition is filed seeking to declare the action of the respondents in trying to demolish the petitioners' building, which is under construction, in Survey No 262/B, Peddavadlapudi Village, Mangalagiri Mandal, Guntur District, as illegal and arbitrary.

The case of the petitioners is that they have been carrying on the constructions in the above-said site only after obtaining permission from the 3rd respondent gram panchayat. Heard learned counsel for the petitioners as well as Sri D. Ramesh, learned Standing Counsel for the 2nd respondent Capital Region Development Authority.

The grievance of the petitioners being limited, this Court is of the opinion that interests of justice would be served better, if a direction is issued to the 2nd respondent not to demolish the structures in the subject premises, except by following the procedure established under law.

With this, the Writ Petition stands disposed of. No costs. Consequently, the miscellaneous Applications, if any shall also stand disposed of.
