HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.11212 OF 2017 ORDER:
This writ petition is filed challenging the memos in Rc.No.A4/966/2016 and R.C.No.A4/965/2016, dated 11-04-2016 issued by the 2nd respondent. Learned counsel for the petitioners says that against the impugned memos, the appeals have been filed before the 3rd respondent on 22-03-2017 and the same are not being disposed of. Meanwhile, the respondent-authorities are trying to dispossess the petitioners basing on the impugned memos dated 11-04-2016. He also submits that separate application was made on 01-12-2015 for conversion of subject land as per deeming clause under Sub-section (6) of Section 3 of A.P. Agricultural Land (Conversion for Non-agricultural Purposes) Act, 2006.
Learned Assistant Government Pleader for Irrigation submits that the subject land is sikam government land and the petitioners cannot convert the same into non-agricultural land.
Learned Assistant Government Pleader for revenue also reiterates the said contention.
In view of the same, the appellate authority shall dispose of the appeals in accordance with law after issuing notice to the petitioners. Till then, status-quo regarding possession over the subject property shall be maintained and
the petitioners can enjoy the land for cultivation purpose. No construction activity shall be taken-up by the petitioners pending disposal of the appeals.
With the above direction, this writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 30-03-2017 Nvl
