Heard.
Learned Government Pleader for Revenue appearing for the respondents has not received instructions, in spite of giving two opportunities.
The petitioners claim to be in possession of the land assigned to their father late Ponduru Balayya as per D-Form Patta, dated 25.05.1986, covering Ac.0.97 cents in Survey Nos.36/2 and 37/1 of Nandigam Village and Mandal. The petitioners claim that they were also issued pattadar passbooks and title deeds. The grievance of the petitioners in this Writ Petition is that neither the petitioners father, during his lifetime, nor the petitioners were issued any notice. In view of the said averments, respondent No.3 is directed not to interfere with the petitioners possession of the aforesaid land, except after giving notice to them and opportunity of filing explanation and thereafter, pass appropriate orders in accordance with law. In case, respondent No.3 receives any objections against the petitioners involvement, he shall not interfere with except after giving notice to the petitioners. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
