THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.575 of 2013 JUDGMENT:

This appeal is filed, under section 100 CPC, assailing the judgment and decree dated 28.09.2012 in A.S.No.47 of 2007 on the file of IV Additional District Court (FTC), Tanuku, wherein whereby the decree and judgment dated 26.03.2007 in O.S.No.690 of 1998 on the file of First Additional Junior Civil Judge Court, Tanuku, dismissing the suit filed by the plaintiff for partition of the suit schedule property was confirmed.

No representation on behalf of the appellant on 27.10.2018. Today also no representation on behalf of the appellant even though the matter is listed under the caption 'for dismissal'. It seems that the appellant is not interested to prosecute the matter. 3.

Hence, the appeal is dismissed for non-prosecution. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
