HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Writ Petition No.10887 of 2008 ORDER:
The petitioner in this writ petition seeks a direction in the nature of writ of Mandamus declaring the action of the 2nd respondent in not disposing of the statutory appeal filed by him as against the orders passed by the 1st respondent in LTR Case No.8/BCM/2008 dated 15.03.2008 in respect of building in an extent of Ac.0.20 cts. situated in Bridge Road, Bhadrachalam, Khammam District as illegal and violative of Articles 14, 21 and 300(A) of the Constitution and consequently direct the 2nd respondent to dispose of the appeal.
2) As can be seen, in LTR Case No.8/BCM/2008 the writ petitioner herein appeared as 2nd respondent and as per the order dated 15.03.2008, the 1st respondent passed decree of ejectment of respondents therein from the land in an extent of Ac.0.20 cts. in Bhadralchalam town and Mandal and the property to be taken into Government custody for assigning the same to eligible tribals as per law in force.
3) Aggrieved by the said order, the petitioner filed CMA No.____ of 2008 and his grievance is that though a decade has passed the same has not been disposed of.
4) Considering the submission of learned counsel for petitioner, this writ petition is disposed of with a direction to the 2nd respondent to dispose of the unnumbered CMA No.___of 2008 preferred by the writ petitioner
expeditiously not later than two (2) months from the date of receipt of a copy of this order, if the said appeal is not already disposed of. No costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed. _________________________ U.DURGA PRASAD RAO, J Date: 16.08.2018 Murthy
