THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 25643 of 2012 ORDER :
Heard Sri K. Sai Rama Murthy, learned counsel for petitioner, and Ms. V. Geetanjali Devi holding for Sri P. B. Vijay Kumar, learned counsel for respondents. Petitioner prayed for the following relief:
"writ of mandamus declaring the action of the respondents in issuing the marks memo dated 11.08.2011 of MBA-I Trimester belonging to the petitioner as failed in all the subjects is illegal, arbitrary and unconstitutional and consequently direct the respondents to declare the results of the two subjects appeared by the petitioner i.e., MPRBA 102 and MPRBA 103 of MBA-I Trimester and to issue fresh memorandum of marks and a certificate of Degree of Master of Business Administration and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."
The respondents are opposing the prayer and have filed a detailed counter affidavit.
Sri K. Sai Rama Murthy, learned counsel for petitioner, having regard to the passage of time from the date of filing of the writ petition till the date of hearing, makes an alternative submission to permit the petitioner to represent to respondent Nos.2 and 3 to permit the petitioner to write MPRBA 102 and MPRBA 103 of MBA-I
Trimester examinations and condone the lapse by taking into consideration the punishment suffered till now by the petitioner for the decision taken by the Vice-Chancellor on 24.11.2010. Learned counsel for respondents submits that if a representation is made by the petitioner, respondent Nos.2 and 3 will consider and do the needful. The statements of learned counsel are placed on record and, accordingly, the petitioner is given four weeks time from today to file a representation for appropriate reliefs before respondent Nos.2 and 3 and respondent Nos.2 and 3 are directed to consider the representation and pass appropriate orders, having regard to the punishment the petitioner has already suffered during the pendency of the writ petition.
With the above observations, the Writ Petition is disposed of. There shall be no order as to costs. Consequently, miscellaneous petitions if any pending in the writ petition shall stand dismissed. ____________________ JUSTICE S.V.
