HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN Civil Revision Petition No.2094 of 2017 ORDER:

The revision arises out of an order passed by the First Appellate Court allowing an application under Section 5 of the Limitation Act, 1963.

2. Heard Mr. Pushadapu Subba Rao, learned counsel for the petitioner.

3. All that the First Appellate Court did was only to condone the delay of 86 days in seeking restoration of an appeal dismissed for non-prosecution. The Court below found that the delay deserved to be condoned. The Court below also imposed costs. I find no justification to interfere with the same. Hence, the Civil Revision Petition is dismissed.

As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
