THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36146 of 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the second respondent in registering the crime No.103 of 2016 as illegal, arbitrary and contrary to the provisions of the Code of Criminal Procedure, and consequently to direct respondents 1 and 2 not to apprehend the petitioner.

Heard and perused the material.

Learned counsel for the petitioner submits that the second respondent registered the crime against the petitioner herein on the basis of the false complaint given by the third respondent and as such, prays this Court to direct respondents 1 and 2 not to apprehend the petitioner. Considering the facts and circumstances of the case, the second respondent is directed to complete the investigation without arresting the petitioner and file final report, if any, in accordance with law. The petitioner is also directed to appear before the second respondent as and when required. The writ petition is accordingly disposed of.
