HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.30452 of 2017 ORDER:

The action of respondent Nos.3 and 4, in interfering with the petitioners' lands in Sy.Nos.146/2, 144/1, 144/3, 146/4 and 146/6 admeasuring Acs.3.02cents, 1.66cents, Ac.0.38cents, Ac.0.46 cents and Ac.1.63 cents respectively situate at Rapthad Village and Mandal, Ananthapur District, is questioned in the Writ Petition as being illegal and arbitrary.

When the petitioners filed W.P.No.17388 of 2017 seeking the very same relief sought for in this writ petition, this Court, by order dated 02.06.2017, having recorded the statement of learned Assistant Government Pleader for Revenue that respondent Nos.3 and 4 are not interfering with the possession of the petitioners, left it open to work out visà-vis respondent Nos.6 and 7 if there is any interference with possession and enjoyment in a properly instituted suit before competent Civil Court.

In the circumstances, filing the instant writ petition for the very same relief sought for in W.P.No.17388 of 2017 is nothing but abuse of process of Court.

The Writ Petition is, accordingly, dismissed.

Miscellaneous Petitions, if any, pending shall stand closed. No order as to costs.
