ORDER

This writ petition is filed for the following relief: "...to issue a writ, order or direction more in the nature of Mandamus declaring the impugned Lr.No.43801/FF1/A1/2006-2, Revenue (fF1) Department, dated 28.10.2006 and the Lr.No.52/CC/AP/98/2003-FF/SZ, dated 30.11.2006 issued by the Government of India, Ministry of Home Affairs, New Delhi as arbitrary, discriminatory, illegal, unjust and opposed to the scheme and theme of sanctioning pension to Freedom Fighters under Swatantrata Sainik Samman (S.S.S.) Pension Scheme and consequently hold that the petitioner is entitled for sanction of Freedom Fighters Pension under Swatantrata Sainik Samman (S.S.S.) Pension Scheme 1980 with effect from the date of application on the basis of the recommendations made by the Revenue authorities with all consequential benefits including arrears of pension etc., and pass such other and further orders as this Hon'ble Court may deem fit and proper."

Learned counsel for the petitioner submits that the name of the petitioner was rejected by the 2nd respondent on the ground that requisite documents are not produced. He also submits that the petitioner has certain documents in his possession, which he intends to produce before the 2nd respondent and therefore, on the basis of the documents which he intends to produce now, his application can be considered afresh in accordance with law. In view of the same, the Writ Petition is disposed of directing the petitioner to approach the 2nd respondent with all requisite documents required in accordance with law, and as and when such application is made, the 2nd respondent shall consider the same and take appropriate decision in the matter. There shall be no order as to costs.

The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
