THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.162 of 2014 ORDER:
This writ petition is filed by the petitioner, under Article 226 of the Constitution of India, seeking to declare the action of the respondent in issuing the Tender Notification bearing No.SW/C/CS3/0188/PEG-2008/PPP/13-14/KMNR/RE-TNDR, dated 17.12.2013, inviting tenders for construction of Godowns and for guaranteed lease for a period of 10 years without considering the representation, dated 22.10.2013, submitted by the petitioner for handing over the already constructed ready made godowns, as illegal and arbitrary and consequently direct the respondent to take over the ready made godowns of the petitioner firm.

When the matter came up for hearing today, the learned counsel for the petitioner called absent and there is no representation on behalf of the petitioner.

On perusal of the record, it is evident that this Court has not passed any interim order in the writ petition and the tender was called during the year 2013. Hence, this Court is of the view that nothing survives in this writ petition for adjudication and the writ petition is liable to be dismissed as infructuous. 4.
Accordingly, the Writ Petition is dismissed as infructuous. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ___________________ RAJA ELANGO,J Date: 17th April, 2017 KL
