Tulugu Appala Naidu v. The State Of Ap.,
SMT JUSTICE T.RAJANI CRIMINAL PETITION No.1733 OF 2018 ORDER:
This Criminal Petition is filed seeking grant of anticipatory bail to the petitioners, who are accused No.3, 5 to 8, 1 to 14, in Crime No.10 of 2018 of Cheepurupalli Police Station, Vizianagaram District.
2.
Heard the learned counsel for the petitioners, learned Public Prosecutor appearing for the respondent-State, and perused the record.
3.
Counsel for petitioners submits that the names of these petitioners were not mentioned in the complaint, but a perusal of the scene of offence panchanama shows that the petitioners, along with other accused, visited the office of the defacto complainant, abused the defacto complainant and damaged the property in the offence of the defacto complainant.
4.
Considering the nature of allegations, this Court opines that this is not a fit case for grant of anticipatory bail to the petitioner.
5.
Therefore, this Criminal Petition is dismissed.
However, police shall follow Section 41 of Cr.P.C. before arresting the petitioners.
6.
Consequently, miscellaneous applications, if any pending, shall stand closed.
