HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.31684 OF 2012 ORDER:

When the matter is taken up for hearing, counsel for the petitioner had contended that the present writ petition is filed seeking correction of the date of birth of the petitioner from 14.10.1952 to 14.10.1954 and during pendency of the writ petition, the petitioner was retired from service on 31.10.2012 as per the office records i.e., 14.10.1952.

Counsel for the petitioner submitted that the respondent is not paying pension and pensionary benefits to the petitioner in view of pendency of this writ petition, therefore, appropriate orders be passed in the writ petition directing the respondent to pay the retiral benefits to the petitioner by duly taking into account that the petitioner has retired from service.

Standing Counsel appearing for the respondent had contended that the petitioner was allowed to continue in service as per the office records and he was retired from service on 31.10.2012 on attaining the age of superannuation as per the office records, therefore, respondents would take appropriate steps for releasing the terminal benefits to the petitioner in accordance with law, within a reasonable period of time. This Court, having considered the rival submissions of learned counsel for respective parties, is of the considered view that since the petitioner was retired from service, the writ petition can be disposed

of directing the respondents to release the retiral benefits to the petitioner within a period of eight weeks from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. No order as to costs.
