Heard Mr.Sashidaran Nair holding for Mr.K.Rajendran and Mr.Benarjee holding for Chetluru Sreenivas.

Counsel for petitioner submits that the respondent during the pendency of Company Petition has been making payments in instalments and settlement arrived at between the parties for clearing the entire admitted amount as per the agreed instalments. Since there is progress in the repayment of admitted amount, the petitioner does not press the Company Petition for the present and seeks liberty to revive the same, if the respondent commits default. By granting liberty as prayed for, the Company Petition is closed.
