This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ accused, to quash the proceedings in C.C.No.1 of 2018 on the file of III Special Magistrate, Hasthinapuram at L.B.Nagar, Ranga Reddy District, registered for the offences under Sections 138 and 142 of the Negotiable Instruments Act, 1881.

Heard the learned counsel for the petitioner/ accused, learned Assistant Public Prosecutor and perused the record. 3 .

It is contended that the petitioner/ accused has taken some loan from one Ch.Venkanna and gave cheques to him. Thereafter, she repaid the entire amount. But the said Ch.Venkanna did not return the cheques and started getting filed complaints under Section of Cr.P.C.

against the petitioner/ accused under Section 138 of Negotiable Instruments Act, 1881, by different persons using the said cheques. He also lodged a report with the police and on that, a criminal case is registered. The petitioner/ accused also gave suitable reply statutory notice in this case, wherein, this defence was also taken.

The contentions now raised before this court are all factual aspects and requires to be determined after due trial basing on the submissions and records produced. To find out the truth or

otherwise of the contentions raised before this Court, the proceedings in the subject Calendar Case have to go on. 5 .

With the above observations, this Criminal Petition is disposed of.

Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
