Heard the learned counsel for the petitioner and the learned Government Pleader for Roads and Buildings.

Petitioner herein claims to be owner of the property bearing House No.1-1089, Sanivarapu Peta, Eluru Town, Elugu Mandalam, West Godavari District. According to the petitioner, he acquired the said property by way of Settlement Deed dated 17.10.2005 vide Document No.11653/2005 in the Office of SRO, Eluru.

The only grievance of the petitioner is that the respondent authorities without following due process of law are trying to demolish and take possession of the property of the petitioner herein. On the other hand, it is submitted by the learned Government Pleader, on instructions, that if the private property of the petitioner is required for the purpose of road widening, the respondents will adhere to due process of law. 4.

In view of the above, the writ petition is disposed of, directing the respondents herein not to meddle with the private property of the petitioner herein bearing House No.1-1089, Sanivarapu Peta, Eluru Town, Elugu Mandalam, West Godavari District without following due process of law. However, it is made clear that the respondents are entitled to acquire the property if the same is required for public purpose, after following the due process of law. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
