HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.36904 of 2016 ORDER:

The present Writ Petition is filed by the petitioner aggrieved over the refusal by the Commissioner of Police - 2nd Respondent herein, whereby he refused to renew the arms licence in favour of the petitioner by an order, dated 01-10-2016.

When the matter is taken up for hearing, it is informed by the learned Assistant Government Pleader that against the order passed by the Commissioner of Police, rejecting the request of renewal of arms licence, the petitioner can avail his remedy by invoking the provisions under Section 18 of the Arms Act, which empowers the petitioner herein to prefer an appeal to the Principal Secretary, Home Department. Hence, the Writ Petition is disposed of with the following directions :

The petitioner is directed to prefer an appeal on or before 25th November, 2016 before the Principal Secretary, Home Department, for renewal of his arms licence, challenging the order passed by the 2nd Respondent herein and on such application being made, the appellate authority is directed to dispose of the appeal within a period of three months thereafter. Accordingly, the Writ Petition is disposed of. No order as to costs. Consequently, Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
