Heard the counsel for petitioner, the learned Government Pleader for Labour, Employment and Training, for respondent nos.1 and 2.

The petitioner retired from the service at the District Level Training Centre, Mahabubnagar as Superintendent on attaining the age of superannuation on 31.01.2014. However, the pensionary benefits have not been released to petitioner. 3.

The petitioner has therefore filed this Writ Petition challenging the inaction of respondents in not paying pensionary benefits to petitioner though he retired from service on 31.01.2014. 4.

Counter-affidavit is filed by 2nd respondent stating that the proposals of Pensionary benefits of the retired employees has to be sent by the concerned Field Officers to Accountant General, Andhra Pradesh and not by the Director, Hyderabad; that the A.D.(T.), Govt.DLTC/ITI, Mahabubnagar vide Memo No.G/W.P.No.36460/ 2016, dt.16.11.2016, was instructed to process the Pension paper in respect of petitioner Sri Md. Tajuddin, Superintendent (Retired) as per Rules in force without further loss of time, and accordingly the petitioner was informed the same; that the petitioner has submitted the revised pension papers on 21.11.2016 to the Assistant Director,

Govt.DLTC/ITI, Mahabubnagar, which was forwarded to the Regional Deputy Director, Hyderabad on the same day and proposal for the payment of pension of petitioner was forwarded to Directorate of Employment and Training vide letter dt.21.11.2016 which was received on 22.11.2016, and the same is under scrutiny for forwarding the same to Accountant General, Andhra Pradesh; and that the petitioner was paid all other retirement benefits such as Earned Leave Encashment, FBF Group Insurance, APGLI and GPF final payment in the year 2014-15.

Having regard to the stand taken by 2nd respondent in the counter-affidavit, the respondents are directed to process the petitioner's pension papers and release appropriate pension to petitioner within a period of three (03) months from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is allowed with the above directions. No order as to costs.

As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed.
