THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.3968 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the inaction on the part of the fourth respondent-Agathavarapadu Gram Panchayat, in disposing of the petitioners' representation dated 21.11.2015, as illegal and arbitrary.

2. Heard the learned counsel for the petitioners and Sri Ravi Cheemalapati, learned standing counsel for fourth respondent.

3. The claim of the petitioners is that they have inherited the land in an extent of Acs.3.96 cents in survey No.3 of Agathavarapadu Village, Peda Kakani Mandal, Guntur District, after death of their father. The petitioners have partitioned the property under a registered partition deed dated 03.4.2014. Alleging that some third parties have raised illegal structures in the land, the petitioners made representation dated 21.11.2015 to the fourth respondent-Gram Panchayat. Aggrieved by the inaction of the fourth respondent in demolishing the illegal constructions raised in survey No.3 of Agathavarapadu village, the present writ petition is filed.

4. At the time of arguments, the only relief sought by the learned counsel for the petitioners is to direct the fourth respondent to dispose of the petitioners' representation dated 21.11.2015. The learned standing counsel for fourth respondent also consented for the same.

5. Having regard to the facts and circumstances of the case and also the submissions made by the learned counsel for both the parties, the fourth respondent is directed to dispose of the petitioners' representation dated 21.11.2015 as expeditiously as possible, preferably within a period of two months from the date of receipt of a copy of this order.

6. With the above direction, the writ petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
