HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.46143 of 2016 ORDER:
The present writ petition is filed by the petitioner through his GPA holder, seeking to declare issuance of Look Out Circular (LOC) against the petitioner in FIR No.443 of 2016 on the file of Women Police Station, D.D., Hyderabad - 3rd respondent, at the instance of the 4th respondent, as illegal and arbitrary.
Heard and perused the material available on record. The offences alleged against the petitioner are under Sections 498-A and 406 IPC and 4 & 6 of the Dowry Prohibition Act. The case of the petitioner is that the 4th respondent is his wife and their marriage took place in the year 2008. Out of wedlock, they blessed with two children. Subsequently, due to differences between them, the 4th respondent left the company of the petitioner and living with her parents and filed the present case against the petitioner and his family members with a view to harass them.
Learned counsel for the petitioner submitted that since the petitioner is residing in USA, LOC was issued against him and that the petitioner is now intending to come to India and he shall appear before the police to cooperate with the investigation, and therefore, the LOC may be recalled.
Considering submissions of the learned counsel for the petitioner, this Court is inclined to pass the following order: The Look Out Circular issued against the petitioner in Crime No.443 of 2016 on the file of the Women Police Station, D.D.,
Hyderabad, is hereby recalled. The petitioner is directed to surrender before the Investigating Officer concerned on or before 31.01.2017 and execute a personal bond for a sum of Rs.10,000/ - (Rupees ten thousand only) with one surety for the like sum and cooperate with the investigation.
Accordingly, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
