HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRL.P.M.P.No.6594 OF 2015 AND CRIMINAL PETITION No.6695 of 2015 COMMON ORDER :
The criminal petition is filed by the petitioner/A3 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.66 of 2015 on the file of Bandi-Atmakur Police Station, Kurnool District for the offences punishable under Sections 363, 342, 427, 365, 171-C, 171-F read with 34 IPC. (It is needless to say that Crl.P.No.6610 of 2015 is allowed on 09.07.2015 by quashing the proceedings against A1). Pending the criminal petition, Crl.M.P.No.6594 of 2015 is filed by the de facto complainant-2nd respondent and petitioner/A3 with joint memo seeking permission to compound the criminal case stating that the matter is amicably settled between the parties outside the Court. The defacto-complainant/2nd respondent filed a memo to permit him for withdrawal of the case against A2, A4 and A5 since he does not want to prosecute against them.
Heard. Perused. Permission is accorded and memo is ordered and also permission is thereby accorded to compound the offences as the parties stated that they amicably settled the matter to purchase peace. Accordingly, the offences are compounded in terms of their compromise at the instance of the de facto complainant since present with the petitioner/A3.
Accordingly, Crl.P.M.P.No.6594 of 2015 is allowed. Consequently, the Criminal Petition is allowed and all the proceedings relating to Crime No.66 of 2015 on the file of Bandi-Atmakur Police Station, Kurnool District are quashed. The bail bonds of A2 to A5, if any, shall stand cancelled.
Miscellaneous petitions, if any pending, shall stand closed.
