THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.7194 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue writ of Mandamus to declare the action of the respondents in not considering the case of the petitioner for promotion to the post of Leading Hand in pursuance of the office order Dt.17-5-1997 on par with his colleagues as high handed and arbitrary action, contrary to APSRTC Regulations, contrary to the circular instructions, capricious, unconstitutional, and as such liable to be set aside in the interest of justice with a consequential direction to the respondents to direction to the respondents to extend all the benefits of Gr-1 mechanic on par with his colleagues of the petitioner including promotion as Leading Hand forthwith." Heard, Sri S.M. Subhan, learned counsel for the petitioner and Sri A. Rama Rao, learned Standing Counsel for respondents' corporation.
During the course of hearing, it is brought to the notice of this Court by learned counsel for the petitioner that for redressal of the grievance of the petitioner herein, the petitioner herein will make necessary application before the respondent authorities and the same may be directed to be disposed of by the respondents, in accordance with law, by fixing some timeframe. The said request is not opposed by learned Standing Counsel for respondents and this Court considers the said request as reasonable. Recording the said submission and having regard to the
nature of controversy, the writ petition is disposed of, without expressing any opinion on the merits of the matter and entitlement of the petitioner, keeping it open for the petitioner herein to make necessary application to the respondents for redressal of his grievance within a period of one month from the date of receipt of a copy of this order and if any such representation is made within the time stipulated the same be considered and appropriate orders be passed by the respondents, in accordance with law, within a period of two (2) months thereafter.
Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
