This Writ Petition is filed by the person, who claims to be the owner of Ac.0-14 cents of land in Survey No.169/8 (learned Counsel for the petitioner submitted that Survey No.169/10 mentioned in the affidavit is a mistake for Survey No.169/8) of East Veerayapalem Village, Darsi Mandal, Prakasam District, filed this Writ Petition, complaining of inaction of respondent No.4 in removing the encroachments, allegedly, made by respondent
Nos.5 and 6 over the public road. The petitioner claimed to have made a representation to respondent No.4 bringing to its notice the alleged encroachment and as no action is stated to have been taken thereon by the said respondent, he filed this Writ Petition.
Mr.Golla Seshadri, learned Standing Counsel for Panchayat Raj Institutions (AP) appearing for respondent No.4, submitted that if the petitioner's representation was received by respondent No.4, it will hold an enquiry, after notice to the petitioner and respondent Nos.5 and 6, and evict respondent Nos.5 and 6, if they are found to have encroached any part of the public road.
The above submission of the learned Standing Counsel for Panchayat Raj Institutions is placed on record and respondent No.4 is directed to do the needful as submitted by the learned Standing Counsel within one month from the date of receipt of this order.
Subject to the above direction, the Writ Petition is disposed of.
