HON'BLE SMT.JUSTICE T.RAJANI CRIMINAL PETITION No.8426 of 2017 ORDER:
Heard learned counsel for the petitioners and the learned Public Prosecutor for the 1st respondent.
Learned counsel for the petitioners submits that petitioners 2 and 3 are residing separately and are not concerned with the allegations made by the 2nd respondent against them. She further submits that the wife of petitioner No.4 filed a petition with similar allegations against the petitioners/accused. Learned Public Prosecutor submits that the earlier case pertains to the year 2014 and that it is numbered as Sessions Case. Learned counsel for the petitioners, when questioned, submits that no discharge petition is filed before the court below. When there is an alternative and effective remedy, it is not necessary that the powers under Section 482 Cr.P.C., need to be invoked by this Court. Hence, the petitioners are directed to file discharge petition before the court below and seek for discharge based on the merits of the case.
The criminal petition is accordingly disposed of. As a sequel, miscellaneous petitions if any pending shall stand closed. ___________ T.RAJANI, J September 21, 2017 MRR
